HP Connect with every Beat - FULL TERMS AND CONDITIONS
1. Definitions
"Eligible Product" means any new and original HP notebook, desktop and/or All-in-One PC (originating from the Promoter) of the following model types:
"Participant" means a resident of, or business trading in, Australia who purchases an Eligible Product from a Participating HP Reseller in Australia during the Promotional Period and is the end user of that Product.
"End user" is a Participant who purchases an Eligible Product for his, her or its own personal use in Australia and not for resale or re-supply or export.
"Participating HP Reseller" includes all authorized HP resellers within Australia.
"Promoter" means Hewlett-Packard Australia Pty Ltd (ABN 74 004 394 763) of 353 Burwood Highway, Forest Hill, Victoria, 3131.
The "Promotional Period" commences on 01 December 2011 and closes on 31 March 2012 (inclusive), or while stock of Reward remains in Prize Pool up to a maximum of 10,000 units, whichever comes first.
The "Extension Period" commences on 1 April 2012 and closes on 30 April 2012 (inclusive).
The "Secondary Extension Period" commences on 1 May 2012 and closes on 31 July 2012 (inclusive).
The “Third Extension Period” commences on 1 August 2012 and closes on 30 September 2012 (inclusive).
"Reward" means a single set of Monster Beats Audio Solo Headphones valued at $279 RRP.
"Prize Pool" means the total quantity of remaining Beats Audio Headphones during the Promotional Period. The Prize Pool is limited to a minimum 5,000 and maximum 10,000 prizes, awarded to the first 5,000 and up to 10,000 claims to be validated by the Promoter. Submission of a claim and postage of supporting documentation do not guarantee a reward. All rewards are subject to availability and will be replaced with an alternative reward of equal or greater value, and the affected participants will be notified accordingly.
"Purchase Start Date" means the first date, starting at 00:01AM on the specified date, that purchases of specified HP Products becomes eligible in the promotion. Any purchases made before this date and time will not be validated.
"Purchase End Date" means the last date, ending at 11:59PM on the specified date, that purchases of specified HP Products are eligible in the promotion. Any purchases made after this date and time will not be validated.
2. Information on how to enter this Promotion and redemption details form part of these terms and conditions. By submitting an entry, Participant agrees to these terms and conditions.
3. For this promotion, during the Promotion Period, there are no excluded retailer stores in Australia.
4. Entry is only open to a Participant. The Promoter reserves the right to verify the validity of each entry, including whether the entrant qualifies as a "Participant". The Promoter reserves the right to disqualify any Participant or person tampering with the entry process or any entrant who does not meet the eligibility requirements or does not comply with these terms and conditions.
5. To be eligible for this Promotion the Participant must: (a) purchase in Australia from a Participating HP Reseller, or the Australian online public store at www.hp.com.au (excluding HP employee & corporate purchase programs) the following eligible products between the specified eligible dates:
(b) Be the end user of that Eligible Product, and (c) completes and submit a valid entry (with all requested information) in accordance with these terms and conditions.
6. For claims on HP Products with an Eligible ‘Purchase End date’ of Monday 30th April 2012, the Participant must: (a) correctly and fully complete an official online claim form at www.hp.com.au/everybeat with all required information by 5PM EST 07 May 2012; (b) print out the completed claim form; (c) send the printed completed claim form with the following proof of purchase documentation: (i) a legible photocopy of the tax invoice applicable to the purchase of the Eligible Products referred to in that claim form; (ii) the Serial Number barcode from the packaging of the applicable Eligible Products to “Connect with every Beat” “Locked Bag 3020, Crow’s Nest, NSW, 1585 by 14 May 2012. Hand written tax invoices and delivery dockets will not be accepted as proof of purchase. Any claim form submitted without the required proof of purchase documentation will be rejected; (d) after validation of claim, and subsequent receipt of validation confirmation email, complete the specified payment process for the postage and handling fee of $19.95 AUD.
For claims on HP Products with an Eligible “Purchase End date’ of Sunday 30th Sept 2012, the Participant must: (a) correctly and fully complete an official online claim form at www.hp.com.au/everybeat with all required information by 5PM EST 07 September 2012; (b) print out the completed claim form; (c) send the printed completed claim form with the following proof of purchase documentation: (i) a legible photocopy of the tax invoice applicable to the purchase of the Eligible Products referred to in that claim form; (ii) the Serial Number barcode from the packaging of the applicable Eligible Products to “Connect with every Beat” “Locked Bag 3020, Crow’s Nest, NSW, 1585 by 14 September 2012. Hand written tax invoices and delivery dockets will not be accepted as proof of purchase. Any claim form submitted without the required proof of purchase documentation will be rejected; (d) after validation of claim, and subsequent receipt of validation confirmation email, complete the specified payment process for the postage and handling fee of $19.95 AUD.
7. Payment of the postage and handling fee of $19.95 AUD must be made by following the steps specified in the claim validation confirmation email. The payment methods available are; (a) VISA; (b) Mastercard; (c) Electronic Funds (bank) Transfer. Rewards will not be shipped until receipt of these monies has been confirmed by the Promoter.
8. There is a limit of three claims for each Participant. There is a limit of one (1) reward for each claim. Any one participant is therefore limited to a maximum of three (3) claims, and therefore three (3) rewards.
9. For claims on HP Products with an Eligible ‘Purchase End date’ of Monday 30th April 2012, all entries must be submitted online by 5PM EST 07 May 2012 and all Proof of Purchase documents (with a printed copy of the confirmation email) must be received by 5PM EST 14 May 2012. Participant(s) will forfeit submissions not made by any of these dates.
For claims on HP Products with an Eligible ‘Purchase End date’ of Sunday 30th September 2012, all entries must be submitted online by 5PM EST 07 September 2012 and all Proof of Purchase documents (with a printed copy of the confirmation email) must be received by 5PM EST 14 September 2012. Participant(s) will forfeit submissions not made by any of these dates.
10. The Promoter will accept no responsibility for late, lost or misdirected mail. Further, to the extent permitted by law, the Promoter excludes liability for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or any website, or any unauthorized intervention, or any combination thereof, including any non-delivery or corruption of entries to the Promoter, injury or damage to Participants' or any other person’s computer related to or resulting from participation in or down-loading any materials in respect of this Promotion. The use of any automated entry software or any other mechanical or electronic means that allows a Participant to automatically enter repeatedly is prohibited and will render all entries submitted by that Participant invalid. If the Promoter has not entered into any correspondence with the Participant prior to the last mail date of the Promotion, it is the responsibility of the Participant to contact the Promoter to ensure their claim has been received and/or has been verified.
11. The Prize Pool is limited to 10,000 prizes being awarded to the first 10,000 claims to be validated by the Promoter. Submission of a claim and postage of supporting documentation do not guarantee a reward. All rewards are subject to availability. The counter displayed on the promotion websites is a only graphical representation of the potential number of prizes remaining in the Prize Pool, due to the validation process this may not represent the actual number of prizes remaining at the time of viewing the counter.
12. To the extent permitted by law, the promoter shall not be liable for any fault pertaining to the reward. Participants will need to liaise directly with the manufacturer of the reward for any repair and/or replacement.
13. This Promotion is not valid in conjunction with any other offer or promotional product bundle outside of this offer.
14. The Promoter reserves the right to modify or extend the closing date and criteria of this Promotion at its discretion.
15. Entries will be deemed invalid if the same tax invoice number is used on more than one entry.
16. The Promoter's decision on all matters pertaining to this Promotion is final and binding and no correspondence will be entered into, except as otherwise stated in these terms and conditions. No correspondence will be entered into after 6 weeks of closing date of this Promotion.
17. Claims are not transferable or assignable. Only the Participant who purchased an Eligible Product may submit a claim.
18. Once claims have been received and verified please allow up to approximately 75 days for receipt of reward after payment of the postage and handling fee has been confirmed by the Promoter.
19. The Promoter does not accept any responsibility for misleading or incorrect information provided by a reseller regarding this Promotion.
20. Liability for any tax on any prizes provided to Participants pursuant to this Promotion shall be the sole responsibility of the Participant. It is recommended that Participants should contact their own accountant or taxation advisor in this regard.
21. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including, without limitation, indirect or consequential loss), or for a personal injury suffered or sustained, as a result of participation in this Promotion, except for any liability which cannot be excluded by law.
22. All claims become the property of the Promoter. The Promoter collects your personal details in order to conduct this Promotion, and may pass that information to its related bodies corporate and agencies assisting with the promotion, which may be outside Australia. If the information requested is not provided, you may not participate in this Promotion. The Promoter will use the information contained in the entry form to contact you if it has any queries regarding claims, and to send prizes. If you give your consent HP may contact you from time to time with information about special offers and products and services that may interest you, but you may unsubscribe later if you no longer wish to receive further marketing information. Participant(s) will forfeit submissions not made by any of these dates.
For claims on HP Products with an Eligible ‘Purchase End date’ of Sunday 30th September 2012, all entries must be submitted online by 5PM EST 07 September 2012 and all Proof of Purchase documents (with a printed copy of the confirmation email) must be received by 5PM EST 14 September 2012. Participant(s) will forfeit submissions not made by any of these dates.
10. The Promoter will accept no responsibility for late, lost or misdirected mail. Further, to the extent permitted by law, the Promoter excludes liability for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or any website, or any unauthorized intervention, or any combination thereof, including any non-delivery or corruption of entries to the Promoter, injury or damage to Participants' or any other person’s computer related to or resulting from participation in or down-loading any materials in respect of this Promotion. The use of any automated entry software or any other mechanical or electronic means that allows a Participant to automatically enter repeatedly is prohibited and will render all entries submitted by that Participant invalid. If the Promoter has not entered into any correspondence with the Participant prior to the last mail date of the Promotion, it is the responsibility of the Participant to contact the Promoter to ensure their claim has been received and/or has been verified.
11. The Prize Pool is limited to 10,000 prizes being awarded to the first 10,000 claims to be validated by the Promoter. Submission of a claim and postage of supporting documentation do not guarantee a reward. All rewards are subject to availability. The counter displayed on the promotion websites is a only graphical representation of the potential number of prizes remaining in the Prize Pool, due to the validation process this may not represent the actual number of prizes remaining at the time of viewing the counter.
12. To the extent permitted by law, the promoter shall not be liable for any fault pertaining to the reward. Participants will need to liaise directly with the manufacturer of the reward for any repair and/or replacement.
13. This Promotion is not valid in conjunction with any other offer or promotional product bundle outside of this offer.
14. The Promoter reserves the right to modify or extend the closing date and criteria of this Promotion at its discretion.
15. Entries will be deemed invalid if the same tax invoice number is used on more than one entry.
16. The Promoter's decision on all matters pertaining to this Promotion is final and binding and no correspondence will be entered into, except as otherwise stated in these terms and conditions. No correspondence will be entered into after 6 weeks of closing date of this Promotion.
17. Claims are not transferable or assignable. Only the Participant who purchased an Eligible Product may submit a claim.
18. Once claims have been received and verified please allow up to approximately 75 days for receipt of reward after payment of the postage and handling fee has been confirmed by the Promoter.
19. The Promoter does not accept any responsibility for misleading or incorrect information provided by a reseller regarding this Promotion.
20. Liability for any tax on any prizes provided to Participants pursuant to this Promotion shall be the sole responsibility of the Participant. It is recommended that Participants should contact their own accountant or taxation advisor in this regard.
21. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including, without limitation, indirect or consequential loss), or for a personal injury suffered or sustained, as a result of participation in this Promotion, except for any liability which cannot be excluded by law.
22. All claims become the property of the Promoter. The Promoter collects your personal details in order to conduct this Promotion, and may pass that information to its related bodies corporate and agencies assisting with the promotion, which may be outside Australia. If the information requested is not provided, you may not participate in this Promotion. The Promoter will use the information contained in the entry form to contact you if it has any queries regarding claims, and to send prizes. If you give your consent HP may contact you from time to time with information about special offers and products and services that may interest you, but you may unsubscribe later if you no longer wish to receive further marketing information.
